What if We Are Unhappy with Your Service to Us?

A client has never terminated us for poor performance. For your peace of mind, our typical five-year management agreement includes a three-year minimum term and permits termination after the third anniversary, subject to its negotiated provisions. We have always believed that if a client does not want us at their club, they should have a clear path to part ways. When clients appreciate what we do, we aim to earn their renewal.

What Is the Typical Length of Your Management Agreement, and What Happens if We Sell the Club Before It Expires?

Our typical agreement has a five-year term with a three-year minimum. However, the initial term, renewal options, and termination rights are negotiated based on the club’s needs, scope of services, and the agreed operating plan.

If you anticipate a sale, the agreement should establish how that transaction affects the management relationship. Depending on the negotiated terms, the agreement may continue with the buyer, be assigned with the required consent, or end under a sale-related termination provision.

Our objective is to provide operating continuity while giving you a clear understanding of your options. The agreement should also address transition support, record delivery, and final financial reconciliation.

Who Owns our Member and Customer Data, Website, Marketing Accounts, and Operating Records—and What Happens to Them if the Management Relationship Ends?

Your access rights should be established at the outset. The agreement should identify the club’s rights to its member and customer records, financial and operating records, website content, domain names, and marketing accounts, as well as the administrator access required to maintain continuity.

Club-owned assets should be distinguished from Bobby Jones Links’ proprietary materials and from third-party software or licensed services. Some systems, subscriptions, or platform accounts may require separate arrangements and may not be transferable. Data access and use must also comply with applicable privacy requirements and contractual restrictions.

If our relationship ends, the agreement should provide for an orderly handover of club-owned records and digital assets, including available data exports and account access. It should specify the timing, format, responsibilities, and any costs of the transfer, together with requirements for retaining or deleting remaining copies.
